Welcome to Iron & Grace Fitness ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at your-domain.com (the "Site") and any related services, products, or content we offer (collectively, the "Services").

By accessing or using our Site and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

2. User Agreement

By using Iron & Grace Fitness Services, you represent that:

Iron & Grace Fitness provides fitness training services, including but not limited to:

• Educational resources and fitness materials

We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.

4. User Responsibilities and Conduct

When using our Services, you agree to:

• Provide accurate health and fitness information
• Follow all safety instructions and guidelines provided by trainers
• Use equipment properly and responsibly
• Respect other members, trainers, and staff
• Maintain appropriate attire and hygiene standards
• Arrive on time for scheduled sessions
• Notify us of any changes in your health status

5. Prohibited Uses

You may not use our Site or Services to:

• Violate any local, national, or international laws or regulations
• Infringe upon intellectual property rights of Iron & Grace Fitness or third parties
• Transmit harmful, offensive, or inappropriate content

• Have cardiovascular, respiratory, or metabolic concerns

We are not medical professionals and do not provide medical advice. Our nutrition guidance is for educational purposes only and is not a substitute for professional dietary counseling.

7. Payment Terms and Cancellation Policy

7.1 Payment

• Payment is required at the time of booking or as specified in your service agreement
• We accept major credit cards, debit cards, and other payment methods as indicated
• All prices are in the local currency and include applicable taxes unless stated otherwise
• Membership fees and package purchases are non-refundable except as required by law

7.2 Cancellation Policy

• Sessions must be cancelled at least 24 hours in advance to avoid charges
• Late cancellations (less than 24 hours) will be charged the full session fee
• No-shows will be charged and counted as a completed session
• Emergency exceptions may be considered at our sole discretion

7.3 Refund Policy

Refunds are handled on a case-by-case basis and may be issued at our discretion for unused services within 30 days of purchase, subject to a processing fee. Digital products and completed sessions are non-refundable.

8. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, videos, workout programs, training materials, and software, is the property of Iron & Grace Fitness or its licensors and is protected by Croatian and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and Services for personal, non-commercial purposes only. You may not:

• Copy, modify, distribute, or reproduce any content without written permission
• Use our trademarks, service marks, or branding without authorization
• Create derivative works based on our content
• Reverse engineer or attempt to extract source code
• Remove or alter copyright notices or proprietary markings

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

Iron & Grace Fitness, its directors, employees, trainers, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or property damage resulting from use of our Services
• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Emotional distress or personal injury claims
• Third-party claims or actions
• Interruption of services or system failures

Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.

Some jurisdictions do not allow limitations on liability for personal injury or certain damages, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Iron & Grace Fitness, its officers, directors, employees, trainers, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Site or Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your negligent or willful misconduct
• Any injury or damage you cause to yourself or others

11. Waiver and Release of Liability

By using our Services, you voluntarily assume all risks associated with physical fitness activities and expressly waive and release Iron & Grace Fitness from any and all liability for injuries or damages that may occur, except in cases of gross negligence or willful misconduct on our part.

This waiver includes, but is not limited to:

• Muscle strains, sprains, and tears
• Cardiovascular complications
• Falls and equipment-related injuries
• Exacerbation of pre-existing conditions
• Any other injuries related to physical activity

12. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to our collection and use of your information as described in the Privacy Policy, in compliance with the General Data Protection Regulation (GDPR) and Croatian data protection laws.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at [email protected]. Termination does not relieve you of payment obligations for Services already rendered or purchased.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the Site and Services immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Harassment of staff or other members
• Non-payment of fees
• Threatening behavior or safety concerns
• Misrepresentation of information

13.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Modifications to Terms

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Croatia, and you hereby consent to the personal jurisdiction and venue of such courts.

16. Dispute Resolution

16.1 Informal Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter through good-faith negotiations.

16.2 Mediation

If informal negotiations fail to resolve the dispute within thirty (30) days, either party may initiate mediation proceedings. The parties agree to participate in mediation in good faith before pursuing litigation.

16.3 Litigation

If mediation is unsuccessful, either party may pursue legal action in accordance with Section 15 (Governing Law).

16.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Iron & Grace Fitness regarding your use of the Site and Services.

These Terms supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

19. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign or transfer these Terms at any time without restriction.

20. Waiver

No waiver by Iron & Grace Fitness of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Force Majeure

Iron & Grace Fitness shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, labor disputes, government actions, or technical failures.
